June 16,2010:The National Cohesion and Integration Commission is just another useless commission packed with political rejects and PNU/ODM big wig minions- Do we really need a commission to tell us what hate speech is ….Can’t the  police and court system determine hate speech cases without a commission?

Commissions in Kenya are known to be  political cesspools/sewers where ex-politicians,political wannabes and other political rejects marinate,soaking up tax payers money. Jokers placed  in commissions by their political godfathers because no other political positions are available .

When the law on cohesion  and intergration was passed in 2008 establishing The National Cohesion & Integration Commission,majority of kenyans(99.9%) did not expect what we are seeing today. We thought this commission would be like the ‘new’ commissions(Waki and Kriegler) we had seen after the PEV. Today the commission has become a tool of oppression,stifling of democracy and free speech in the name of ensuring integration and national cohesion. Why? Because it is headed by an archeologist who cant differentiate between,opinions,lies,free speech and hate speech.Isnt it too much to expect political flunkies & archeologists to understand the difference in law between free speech and hate speech particularly in Kenya? What Kenya needs is  a new commission that is qualified,vetted and independent .Perhaps(if its not too much to ask)one staffed with lawyers and social scientist not relic hunters and stooges if we want to get the job done.

After this weeks performance ,the only thing we as Kenyans can look forward to is that this commission  and commissioners will enjoy their 5 minutes of fame before we forget them just like all other useless commission members we have had  in kenya since 1975.This has to be the lowest we have sunk in choosing commissioners- scraping the bottom of our bottomless political latrine

  3. Just to Make a comment.:I read Dr. Kibunja’s article this morning on the East African Standard. I hope Dr.Kibunja will work tirelessly to deal with hate speech mongers for as long as he is in the office. I do belief that dealing with hate mongers, no matter their class in society will bring cohesion in the long run. I hope this will be accompanied with civic education in the years to come. Cohesion cannot be achieved before we learn to respect all Kenyans without prejudice. It has to be done without bias, and I am not saying there is bias, but it has to be. People must be held responsible for their actions. If necessary, there has to be continues review where the puplic has to be sensitised to help. Law enforcement has to be involved. I do know that you as the agency know this better than I am saying. It definately is a postive move in the right direction.

The concept of a commission to promote cohesion and unity is noble.However the current commissioners have already tainted the commission by the biased approach.The commission should be disbanded and reconstituted with non partisan Kenyans, who are not political appointees beholden to those who appoint them. Until commissions are staffed with independent , honest Kenyans who are willing to ensure unity through fairness, we will continue to create divisions.As it stands today the actions of selective naming and shaming by the commission have already divided the country further.Their actions have not in anyway improved our unity .if anything they have created new divisions

  5. The Commission has a National mandate in line with the NCIC ACT 2008 that created It. The Commission only recommends for prosecution what they perceive is hate speech. The courts will rule. Its only the Promoters of hate speech and Discriminators are worried that they may cross paths with the Commission. It is not enough to try to berate or degrade the persons of the commissioners. Kenyans are happy with the Commission. It is not enough to proclaim and recommend action, it is better to act- that’s what NCIC is doing. Heko Mzalendo Kibunja.

  6. Johnstone Kioko -Which ‘kenyans’ are happy with the commission. Are this the same ‘Kenyans’ who will not allow meetings to take place in Suswa or the same ‘Kenyans’ who have used ODM’s 2007 campaign of hate ,lies and vilification against the No campaign on the constitution.Where different Legal opinions are called lies rather than a different legal opinion! Are they the same ‘Kenyans’ who appointed the commissioners to sing their tune! When commissions and commissioners start serving ‘ALL KENYANS’ and not just the ‘Kenyans’ you speak of, We will give them the respect they deserve .Mzalendo and his fellow minions are a waste of tax payers money. They have not brought about National Cohesion or integration! They are only serving the ‘Kenyans’ who appointed them at the expense of All Kenyans.

    The commissioners can not even differentiate between slander, lies, opinion and hate speech.If you have studied law you know there is a difference in all four. How can the commission do its job when it does not know what Hate speech is.If the commissioners were independent lawyers and not politicians and archeologist like the Ms Onyango’s and the Dr Mzalendo’s we would be further along in uniting the nation!

With all due respect,the NCIC is one great opportunity of healing this country and steering it on in the right direction.It may not be in order to pour cold water to such a great institution.It takes the support of every one to ensure success.Scoring at it like the blog administrator is doing is just not what we want.It not about the individuals or their qualifiaction,it is about the will to deliver this country out of the claws of disunity.Havent we seen qualified lawyers or Doctors or engineers who actaully know knothing about their profession? Yes Kibunja may be an archeologist by profession but a reconciler by faith.Let the process go on and let support it.

    It is not the institution we castigate but the incompetence of the commissioners and their integrity

  13. i want to know how to get the officials/ the team from your commission to come in my town to talk to youths so that they can keep peace. Nambale town was affected by the post election violence. several houses were burnt. and some pple were evicted from this town. But to date i have not seen any effort to address the issue. Politician are already come back with the same hate messages. I work with the youths in these community.

    If you think that this is a not a time bomb that is waiting to explode, then I am sure you are in the darkness. Can’t you ask why the region is occupying the security docket and not any other? This is more dangerous than hate speech itself. Fight this vice before coming to hate speech. Unless you are fearing to tell the president on his face that whatever that he is doing is not in the interest if Kenyans. We know that your office is capable of rectifying this tribal and barbaric behavior.
